Official Miranda Warning- For DUI/DWI

It is not necessary for the Police to read a suspect their Miranda Warnings unless they are under "Custodial Interrogation."

Here is the New Jersey Form:

•1. You have the right to remain silent. Do you understand that?

•2. Anything you say can and will be used against you in a court of law. Do you understand that?

•3. You have the right to talk to a lawyer and have him present with you while you are being questioned. Do you understand that?

•4. If you cannot afford to hire a lawyer, one will be appointed at no cost to represent you before any questioning, is you wish one? Do you understand that?

•5. If you agree to talk to us, a decision to waive these rights is not final. And you may withdraw your waiver whenever you wish, either before or during questioning. Do you understand that?

I acknowledge that I have been advised of and understand the constitutional rights listed on this card.

You are then asked to sign and date, with a signature from the interviewing Officer and a witnessing Officer.
